Welcome to NovaGlow. This Master Agreement constitutes a legally binding contract between you (the "User") and NovaGlow. By accessing or using our services, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these terms, you are prohibited from using our services.

1. Legal Capacity and User Obligations

By entering into this agreement, you warrant that you possess the full legal capacity to enter into a binding contract in your jurisdiction. You agree that your use of the site is for lawful purposes only and that you will not engage in any activity that interferes with or disrupts our operations.

2. Absolute Disclaimer of Medical Liability

NovaGlow products are strictly stress-relief aids and are NOT medical devices, supplements, or therapeutic treatments. We explicitly disclaim any liability for any health-related outcomes, whether positive or negative, resulting from the use of our products. Users acknowledge that these products are purchased at their own risk, and NovaGlow is not a substitute for professional medical, psychiatric, or psychological consultation.

3. Payment and Transactional Integrity

All payments are processed via Tap Payments. By confirming a transaction, you represent that you are an authorized user of the payment method. NovaGlow strictly adheres to PCI-DSS compliance standards; we do not store, process, or have access to your full financial/card details. Any claims related to financial data breaches must be directed to the payment gateway provider.

4. Indemnification and Liability Caps

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless NovaGlow, its owners, and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your misuse of our products or violation of these terms. In no event shall NovaGlow’s cumulative liability exceed the total purchase price of the specific product that gave rise to the claim.

5. Proprietary Rights and Intellectual Property

All branding, including the name NovaGlow, logos, designs, and descriptive content, is the exclusive intellectual property of the business. Unauthorized reproduction, distribution, or commercial exploitation of our assets is strictly prohibited and will be met with legal action.

6. Termination of Service

NovaGlow reserves the absolute right to suspend or terminate your access to the store at any time, without prior notice, for conduct that we, in our sole discretion, believe violates these terms or is harmful to our brand, other users, or third parties.

7. Force Majeure

NovaGlow shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, strikes, pandemics, or disruptions in shipping/logistics providers.

8. Jurisdiction and Dispute Resolution

This Agreement is governed by the laws of the Hashemite Kingdom of Jordan. Any disputes, controversies, or claims arising out of or relating to these Terms shall be resolved exclusively through the competent courts of Jordan.

9. Entire Agreement

This document constitutes the entire agreement between you and NovaGlow regarding the use of our services, superseding any prior communications or agreements.
